Platform Terms of Use

Applies to: All visitors/users of the BuildHero website, app and related interfaces (collectively, the "Site").

1. 1. Acceptance
   1. 1.1 By accessing or using the Site, you agree to these Terms of Use and our Privacy/POPIA notices. If you create an account or make a Booking, the Customer Terms & Conditions also apply.
2. 2. Access and Availability
   1. 2.1 We provide the Site on an “as is” and “as available” basis and may modify, suspend or discontinue features at any time. We endeavour to maintain reasonable uptime but cannot guarantee uninterrupted, secure or error-free access.
3. 3. Acceptable Use and Restrictions
   1. 3.1 You must not (and must not allow others to):
      1. 3.1.1 Use the Site for unlawful purposes, spam, scraping, data mining, or to harass/abuse others;
      2. 3.1.2 Copy, frame, mirror, deep-link, decompile, reverse engineer, circumvent security or access controls;
      3. 3.1.3 Upload malware, infringing or defamatory content, or content that violates privacy/POPIA;
      4. 3.1.4 Misrepresent identity or affiliation, or interfere with the integrity or performance of the Site;
      5. 3.1.5 Collect payments off-Platform for Jobs initiated via BuildHero, or solicit bypass of the Platform.
4. 4. Accounts and Security
   1. 4.1 You are responsible for safeguarding credentials and for all activity on your account. Notify us promptly of suspected compromise. We may restrict access for fraud risk, repeated cancellation/no-show patterns, abusive conduct or policy breaches.
5. 5. User Content; Reviews
   1. 5.1 If you submit content (including reviews, photos or messages), you grant BuildHero a worldwide, non-exclusive, royalty-free licence to host, reproduce and display such content for Platform operation and promotion, subject to POPIA. We may moderate/remove unlawful or policy-breaching content.
   2. 5.2 You warrant you have the necessary rights to any content you upload and that it does not infringe third-party rights.
6. 6. Intellectual Property
   1. 6.1 The Site, Platform software, logos and brand elements are owned by BuildHero and/or its licensors and are protected by IP laws. No rights are granted other than limited use of the Site under these Terms.
7. 7. Third-Party Links and Suppliers
   1. 7.1 The Site may contain links to third-party sites or Supplier profiles. We do not endorse and are not responsible for third-party content or services. Supplier information is provided by Suppliers and may not be independently verified by us.
8. 8. Privacy Policy
   1. 8.1 We process personal information to operate the Site/Platform and facilitate Bookings in line with our POPIA notices and security practices, and share data with Suppliers/sub-operators where necessary. Please see our Privacy Policy.
9. 9. Disclaimers and Liability
   1. 9.1 We disclaim all implied warranties to the maximum extent permitted by law and do not warrant that the Site will meet your requirements or be free from interruption or error.
   2. 9.2 BuildHero is not responsible for the Partner Services (which are delivered under your Supplier Contract with the Supplier).
10. 10. Suspension and Termination
    1. 10.1 We may suspend or terminate access (in whole or part) for breach, abuse, fraud risk or to protect the Platform, with or without notice in urgent cases. This does not limit any other remedies.
11. 11. Governing Law and Jurisdiction
    1. 11.1 These Terms of Use are governed by and construed in accordance with the laws of the Republic of South Africa.
12. 12. Changes
    1. 12.1 We may update these Terms of Use from time to time. Material changes will be notified via the Site or email; continued use after the effective date constitutes acceptance.
